The better question is:"what temperature has this kit been stored at?"
If your kit has been in a cool basement or the like, the yeast ought to be still be good and other ingredients okay. If the kit had been kept in the hot garage/attic/ storage building, then the yeast will be dead and the LME/ DME will be nasty, too.
The Basic Brewers Best 1000 kit wins in my opinion because it comes with a thermometer and hydrometer, which the other kit does not. These are important tools for any homebrewers. Alternatively, of course, you can just purchase these separately. But the Midwest kit is really incomplete.
